Terms of Service

1. Acceptance of Terms

By accessing or using Erosia ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. Erosia is operated by The Erosia Team ("the Operator").

2. Eligibility

You must be at least 18 years of age to use Erosia. By using the Service, you represent and warrant that you are 18 years of age or older. The Operator reserves the right to terminate accounts of users who are found to be under 18.

3. Description of Service

Erosia is a SaaS platform that provides AI-powered image and video generation services. Users may generate content using credits purchased through the platform or included in their subscription plan.

4. Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify the Operator immediately of any unauthorized use of your account. The Operator is not liable for any loss resulting from unauthorized use of your account.

5. Credits and Subscriptions

Erosia offers subscription plans and one-time credit purchases. Credits are consumed when generating images or videos. Subscription credits reset monthly on your billing date. Unused credits do not carry over between billing periods unless otherwise stated. Credit purchases are non-refundable except where required by applicable law.

6. Payments

All payments are processed by Stripe. By making a purchase, you agree to Stripe's terms of service. Prices are listed in USD and may be subject to local taxes. The Operator reserves the right to change pricing at any time with reasonable notice.

7. Acceptable Use

You agree not to use Erosia to generate content that:

  • Is illegal under applicable law
  • Infringes on the intellectual property rights of others
  • Depicts, promotes, or glorifies violence, gore, or harm to any person or animal
  • Depicts or simulates rape, sexual assault, or any non-consensual sexual act
  • Contains child sexual abuse material (CSAM) of any kind — strictly and absolutely prohibited
  • Sexualizes minors in any form, including AI-generated depictions
  • Uses the likeness, face, or identity of any real person without their explicit consent — including but not limited to deepfakes, non-consensual intimate imagery (NCII), or impersonation
  • Depicts real public figures, celebrities, or private individuals in sexual, violent, or otherwise harmful scenarios
  • Reproduces or imitates copyrighted characters, brands, or intellectual property without authorization — including fictional characters, logos, or trademarked imagery
  • Is intended to deceive, mislead, or spread disinformation — including realistic fake images or videos of real events, people, or statements
  • Is used to harass, threaten, stalk, defame, or harm any individual
  • Promotes hatred, discrimination, or violence against any group
  • Violates any applicable laws or regulations

You also agree not to:

  • Attempt to reverse engineer, decompile, scrape, or extract the underlying AI models, workflows, or infrastructure of the Service
  • Resell, sublicense, or otherwise redistribute access to the Service or your credits to third parties
  • Use the Service to generate content in bulk for the purpose of spam, phishing, or any other deceptive mass distribution

Violation of these rules — particularly any content involving minors, non-consensual acts, or unauthorized use of real persons' likeness — will result in immediate and permanent account termination without refund, and may be reported to the relevant authorities.

8. Intellectual Property

You retain ownership of the content you generate using Erosia, subject to any restrictions imposed by the underlying AI models. The Operator does not claim ownership of your generated content. You grant the Operator a limited, non-exclusive license to store and display your content solely for the purpose of operating the Service.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, express or implied. The Operator does not guarantee that the Service will be uninterrupted, error-free, or that generated content will meet your expectations.

10. Limitation of Liability

To the maximum extent permitted by law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. The Operator's total liability shall not exceed the amount you paid in the 12 months preceding the claim.

11. Termination

The Operator reserves the right to suspend or terminate your account at any time for violations of these Terms. You may delete your account at any time by contacting us. Upon termination, unused credits are forfeited unless required otherwise by law.

12. Governing Law

These Terms are governed by the applicable European Union law. Any disputes shall be resolved in the competent courts of the Europen Union.

13. Changes to Terms

The Operator may update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms. Users will be notified of material changes via email.
